By enrolling in an Earth Nail Spa membership or using our services, you agree to the following terms and conditions.
Membership Terms & Conditions
1. Membership Billing
- The monthly membership price is $129.
- Upon enrollment, members will be charged a prorated amount based on the date of sign-up.
- All memberships will then be billed on a universal billing date of the 1st of each month.
- If a payment fails, the system will attempt to process payment up to three times.
- If payment is not successfully processed after three attempts, the membership will be automatically canceled.
2. Booking & Scheduling Appointments
- Membership is designed to provide ongoing access to services, subject to availability.
- To ensure fair access for all members, each member may hold a maximum of:
- 2 manicure appointments
- 2 pedicure appointments on the schedule at any given time.
- Once an appointment is completed, members may book additional services.
- Appointment availability is limited and based on demand. Members are encouraged to:
- Book in advance
- Check availability regularly
- Utilize the waitlist when applicable
3. Appointment Late Cancellation & No-Show Policy
- Appointments must be canceled or rescheduled at least 24 hours in advance.
- Cancellations made within 24 hours of the appointment time will incur a $25 late cancellation fee per service booked.
- Failure to attend a scheduled appointment will result in a $25 no-show fee per service booked.
- Any $25 fee or outstanding balance on the account must be paid prior to using membership benefits.
- Repeated violations may result in restricted booking privileges or membership review.
4. Membership Freeze Policy
- Members may freeze their membership at any time.
- A $10 monthly freeze fee will apply beginning on the next billing cycle (1st of the month).
- While membership is frozen:
- Booking new services is not permitted.
- All future appointments will be automatically canceled.
- To reactivate a membership, members must contact Earth Nail Spa directly.
- Upon unfreezing, the member will be charged the full monthly membership fee, regardless of the date of reactivation.
- Members may freeze their membership multiple times.
- While memberships are frozen, members may continue to use spa services on a pay-per-visit basis.
- Membership pricing will remain the same as the original purchase price upon reactivation.
5. Membership Cancellation
- Members may cancel their membership at any time through the app.
- Members must cancel by the 20th of the month for the cancellation to take effect on the 1st of the following month. Membership privileges remain active through the end of the billing period.
- No refunds will be issued for unused services or time remaining in the billing cycle.
- If a member is experiencing difficulty booking, the freeze option is recommended as an alternative to cancellation.
6. Membership Usage
- Membership is non-transferable and may only be used by the registered member.
- Sharing memberships or booking services for others under a membership is not permitted.
7. Refund Policy
- Earth Nail Spa does not provide refunds for unused services.
- All membership fees are final once billed, except where explicitly stated in limited-time promotions.
8. Right to Refuse or Terminate
Earth Nail Spa reserves the right to:
- Refuse service
- Suspend or terminate a membership
- Restrict booking privileges
at any time, at the sole discretion of ownership, with or without notice, including but not limited to violations of these terms or inappropriate conduct.
9. Policy Updates
- Earth Nail Spa reserves the right to update or modify these terms and conditions at any time.
- Continued use of membership services constitutes acceptance of any updated terms.
General Terms & Conditions
The following terms apply to all guests and service users of Earth Nail Spa, including those who are not enrolled in a membership.
10. Appointments & Service Policy
- Earth Nail Spa operates by appointment. Walk-ins are accommodated based on availability.
- Please arrive on time for your appointment. Late arrivals may result in a shortened or rescheduled service.
- Earth Nail Spa reserves the right to refuse service to any guest at its sole discretion.
11. Payments
- All services must be paid in full at the time of service.
- Earth Nail Spa accepts all major credit cards, debit cards, and approved digital payment methods.
- Prices are subject to change without notice.
12. Health & Safety
- Guests are responsible for disclosing any health conditions, allergies, or sensitivities prior to receiving services.
- Earth Nail Spa follows all applicable health and sanitation guidelines. If a guest presents with a condition that may pose a risk to staff or other guests, Earth Nail Spa reserves the right to decline service.
13. Limitation of Liability
- Earth Nail Spa is not responsible for personal items lost, stolen, or damaged on the premises.
- Earth Nail Spa's liability for any claim arising from a service is limited to the cost of that service.
- By receiving services, guests acknowledge and accept any inherent risks associated with nail and spa treatments.
Email & SMS Marketing
14. Email Marketing
Earth Nail Spa uses HubSpot and Zenoti to manage email marketing communications. By providing your email address, you consent to receive marketing emails from Earth Nail Spa, including:
- Promotional offers and seasonal specials
- Membership updates and billing reminders
- New service announcements and spa news
You may opt out of marketing emails at any time by clicking the unsubscribe link in any email communication. Transactional messages related to your membership or booked appointments will continue regardless of marketing preferences.
15. SMS Marketing (Text Messages)
Earth Nail Spa uses HubSpot to send marketing SMS messages to customers who have provided explicit consent. The following terms apply to all SMS communications:
Consent & Opt-In
- By providing your mobile number and checking the SMS consent box on our sign-up form or membership enrollment, you consent to receive recurring marketing text messages from Earth Nail Spa.
- SMS consent is optional and separate from other service agreements. Your consent to SMS is not required to purchase any product or service.
- Consent is collected through a separate, unchecked checkbox. It is not bundled with any other agreement.
Message Types & Frequency
- Message types include: appointment reminders, promotional offers, membership updates, and spa announcements.
- Message frequency varies. You may receive up to 4 messages per month.
Rates & Carrier Disclaimer
- Message and data rates may apply. Contact your wireless carrier for details.
- Carriers are not liable for delayed or undelivered messages.
How to Opt Out
- Reply STOP to any message to unsubscribe from SMS marketing at any time. You will receive a one-time confirmation of your opt-out.
- For assistance, reply HELP or contact us directly at [phone number] or [email address].
Privacy of SMS Data
- Earth Nail Spa does not share, sell, or transfer SMS opt-in data or consent information to any third parties, affiliates, or non-affiliates for marketing purposes.
All above data-sharing categories exclude text messaging originator opt-in data and consent. This information will not be shared with any third parties, excluding aggregators and providers of the text message services used to deliver communications.
- SMS messaging is powered by HubSpot via Twilio. Messages are sent from a 10-digit long code (10DLC) US-based number registered with US carriers.
