1. Acceptance of terms
By booking an appointment, using our services, visiting our salon, or becoming a member of Earth Nail Spa ("we," "our," or "us"), you ("client," "customer," or "you") agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.
These Terms and Conditions should be read in conjunction with our Privacy Policy, which is incorporated by reference.

2. APPOINTMENT AND BOOKING POLICIES
2.1 Booking Appointments
Appointments may be booked:
- Online through our website at earthnailspa.com
- Mobile app (available for download - members get priority scheduling)
- In person at our salon
- Walk-ins are always welcome based on availability
2.2 Cancellation Policy
Non-Member / Walk-In Clients:
12-Hour Cancellation & Downgrade Policy
- We require at least 12 hours' notice for any cancellations, reschedules, or service downgrades
- Cancellations or changes made with less than 12 hours' notice will be charged 50% of the total service amount
- No-shows are considered cancellations made within two hours of the appointment time and will also be charged 50% of the total service amount
Members:
12-Hour Cancellation & Downgrade Policy
- We ask members to provide at least 12 hours' notice for cancellations, reschedules, or service downgrades
- Cancellations made with less than 12 hours' notice, or missed appointments, will incur a $25 flat fee
2.3 No-Show Policy
A "no-show" occurs when a client fails to arrive for a scheduled appointment without providing notice. No-shows are subject to the cancellation fees outlined in Section 2.2 above.
2.4 Late Arrival Policy
We provide a 10-minute grace period for late arrivals. However:
- Clients who are late more than 10 minutes may have their appointment cancelled and charged a rescheduling fee
- Clients arriving more than 15 minutes late will need to reschedule their appointment and will be charged as a no-show
- Late arrivals may result in shortened service time to accommodate subsequent appointments
- We cannot guarantee full service completion for late arrivals
We recommend arriving 5-10 minutes early to check in and relax in our Serenity Room before your service.
2.5 Rescheduling
Clients may reschedule appointments at any time, subject to availability, provided they meet the cancellation notice requirements outlined in Section 2.2. Failure to provide adequate notice will result in applicable fees.
3. PAYMENT POLICIES
3.1 Payment Methods Accepted
We accept the following payment methods:
- Cash
- Credit cards (VISA, Mastercard, AMEX)
- Debit cards
- Note: Cash cannot be used for Zenoti system processing fees
3.2 Deposits
Deposits are NOT required for any services. However, we require a credit card on file for all appointments, but no deposits are charged in advance.
3.3 Gratuity/Tipping
Gratuity is always appreciated but never required. Our staff is paid a living wage, and tips are entirely at your discretion and go directly to your service provider.
3.4 Refund Policy
We do offer refunds under certain circumstances. If there is a service error, we will refund to their account credit at the discretion of the manager. Account credits may be used toward future services and products.
Refunds are generally not provided for:
- Services that were completed as requested
- Changes of mind after service completion
- Dissatisfaction with color or style choices you approved

3.6 Payment Due
Payment is due at the time services are rendered unless alternative arrangements have been made with management.
4. SERVICE POLICIES
4.1 Service Guarantee
7-Day Service Guarantee
We stand behind the quality of our work with our comprehensive service guarantee:
- If you experience any issues with your service within 7 days, contact us immediately at info@earthnailspa.com.
- We will repair, redo, or correct any service at no additional charge
- Nail art and design work is guaranteed for 3 days
What's NOT Covered:
- Breakage due to client misuse, picking, breaking, or trauma (treated as a nail repair at $10 per nail)
- Damage from excessive wear or accidents
- Natural wear and tear
- Damage resulting from failure to follow aftercare instructions
- Intentional damage or damage from external activities
- Pre-existing nail or skin conditions
4.2 Sanitation and Hygiene
We are committed to the highest standards of sanitation and exceed industry requirements:
Hospital-Grade Sterilization:
- Every tool undergoes a three-step sterilization process using hospital-grade autoclave technology—the same method used for surgical instruments
- All implements are individually wrapped and opened in front of you
- Files and buffers are single-use and disposed of after each client
- We follow all state and local health regulations
- All equipment is properly sanitized and disinfected between clients
- We maintain a clean and hygienic environment at all times
4.3 Client Health Screening
Yes, we require disclosure of certain health conditions. We reserve the right to refuse or modify services if a client:
- Has open wounds, cuts, or abrasions
- Has visible infections (fungal, bacterial, or viral)
- Has contagious skin conditions
- Has other medical conditions that may pose a risk during service
Required Disclosures: You must inform us if you have:
- Diabetes
- Circulatory issues or poor circulation
- Peripheral neuropathy
- Immune system disorders
- Blood clotting disorders
- Skin conditions or infections
- Allergies to products or materials
This policy protects both our clients and staff.
Failure to disclose relevant medical conditions may result in:
- Refusal of service
- Termination of service
- Voiding of our service guarantee
- Client assuming full liability for any complications
4.4 Consultation Requirements
No formal consultation is required, but our technicians are trained to consult with you while performing services. We will assess your nail and skin condition and recommend appropriate services.
For complex services or first-time clients, we encourage discussing your needs and preferences with your technician before service begins.
4.5 Service Modifications
Yes, at the discretion of the nail technician, services may be modified based on nail or skin condition. Our technicians reserve the right to:
- Decline certain services if they determine your nails or skin are not suitable
- Recommend alternative services better suited to your needs
- Adjust techniques to accommodate your specific nail health
- Stop service if conditions worsen during treatment
- Require additional prep work or treatments before proceeding
This ensures both your safety and the quality of the final result.
4.6 Clean Beauty Commitment
We exclusively use clean, safe, premium products:
- Performance Polish: Hypoallergenic, vegan polish system with no UV light or harsh chemicals
- European Gel Polishes: TPO-Free and HEMA-Free
- No toxic fumes or harsh chemicals
- All products meet the highest safety standards
5. MEMBERSHIP PROGRAM
5.1 Membership Eligibility
To become a member of Earth Nail Spa, you must be:
- 18 years of age or older, OR
- Under 18 years of age with written parental or legal guardian consent
5.2 Membership Options and Benefits
SERENITY MEMBERSHIP - $129/month
Our flagship individual membership includes:
- Unlimited Rooted Manicures (choose Performance Polish, Traditional Gel, Builder Gel, or Gel-X Extensions)
- Unlimited Grounded Pedicures (choose Performance Polish or Gel polish)
- Full access to Serenity Room with red light therapy and blue light therapy
- Unlimited hydromassage wave machine sessions with aromatherapy
- All gel removals included (traditional gel, builder gel, Gel-X, hard gel, polygel, dip powder, acrylics)
- Priority booking through our mobile app
- Complimentary beverages during every visit
- 12-hour cancellation policy with $25 fee for late cancellations/no-shows
FAMILY MEMBERSHIP - $199/month
Perfect for couples, parent-child duos, or any two family members:
- All Serenity Membership benefits for TWO people
- Share unlimited manicures and pedicures between both members
- Combined appointment flexibility—book together or separately

5.3 What's NOT Included in Membership
Memberships do not include:
- Nail art and design work (available at member discounted rates: Tier 1 $15, Tier 2 $30)
- Specialty add-ons: Collagen gloves/socks ($10), moisturizing masks ($10), extended massages ($15)
- Gratuity (always appreciated but never required)
5.4 Membership Fees and Payment
- Serenity Membership: $129/month
- Family Membership: $199/month
- Monthly fees are automatically charged to the credit card on file on the date you joined
- Membership fees are non-refundable
5.5 Membership Cancellation
To cancel a membership:
- Members must submit their request by the 20th of the month before their next billing cycle
- Example: To cancel effective February 1st, you must submit your cancellation request by January 20th

5.6 Membership Terms
- Month-to-month membership with no long-term contract
- Auto-renewed monthly—there is no set contract length
- Cancel anytime with 30 days written notice (must submit by the 20th of the month)
- Services must be used by the member—not transferable
- Family memberships cover 2 designated family members only
- Unused services do not roll over month to month
- Membership can be paused for up to 60 days per year for medical reasons or extended travel
5.7 Membership Usage
- No monthly limits on services
- Members can book appointments as frequently as desired
- Must book appointments through our mobile app for priority access
- Services cannot be transferred, sold, or shared outside designated family membership
- Members receive discounted rates on nail art and add-on services
6. LIABILITY AND SAFETY
6.1 Allergic Reactions
There's no way we can guarantee that someone will not have an allergic reaction. We are not liable for allergic reactions to products used during services.
Client Responsibility:
- You must inform us of any known allergies before service begins
- You acknowledge that you use our services at your own risk
- We are not responsible for allergic reactions to products, even if previously used without issue
Our Commitment:
- We use professional-grade, clean beauty products
- We will provide product information and ingredient lists upon request
- We will stop service immediately if you experience discomfort or adverse reactions
6.2 Service Modifications for Health and Safety
Yes, at the discretion of the nail technician, we may modify or refuse services based on nail or skin condition to ensure your safety and the quality of the service.
6.3 Medical Conditions
Yes, we require clients to disclose certain medical conditions, including but not limited to:
- Diabetes
- Circulatory issues or poor circulation
- Peripheral neuropathy
- Immune system disorders
- Blood clotting disorders
- Skin conditions, infections, or sensitivities
- Any condition that affects healing or circulation
Failure to disclose relevant medical conditions may result in:
- Refusal of service
- Termination of service mid-appointment
- Voiding of our service guarantee
- Client assuming full liability for any complications or adverse reactions
6.4 Limitation of Liability
To the fullest extent permitted by law, Earth Nail Spa, its owners, employees, and contractors shall not be liable for:
- Allergic reactions to products
- Injuries resulting from failure to follow aftercare instructions
- Pre-existing nail or skin conditions
- Infections resulting from client behavior after service (picking, improper care, exposure to contaminants)
- Adverse reactions from undisclosed medical conditions
- Damage from client misuse, trauma, or accidents
- Any indirect, incidental, or consequential damages
Our total liability for any claim shall not exceed the amount paid for the service in question.
6.5 Assumption of Risk
By using our services, you acknowledge and agree that:
- Nail and spa services carry inherent risks
- You are voluntarily participating in services with full knowledge of these risks
- You assume all risks associated with receiving services
- You release Earth Nail Spa from liability for injuries or damages except those caused by our gross negligence or willful misconduct
6.6 Indemnification
You agree to indemnify and hold harmless Earth Nail Spa, its owners, employees, and contractors from any claims, damages, losses, liabilities, or expenses (including reasonable legal fees) arising from:
- Your failure to disclose medical conditions, allergies, or sensitivities
- Your failure to follow aftercare instructions
- Your breach of these Terms and Conditions
- Your negligent or intentional misconduct
7. PROPERTY AND BEHAVIOR
7.1 Personal Belongings
No, we are not liable for lost or stolen personal belongings. You are responsible for your personal items at all times.
We recommend:
- Keeping valuables with you or secured in your vehicle
- Not bringing unnecessary valuables into the salon
- Being mindful of your belongings during your service
- Using our provided storage areas at your own risk
7.2 Client Conduct
We only allow 1 glass of alcohol per client. We reserve the right to deny service to anyone who is:
- Rude or disrespectful to staff or other clients
- Aggressive or threatening in behavior or language
- Disruptive to the salon environment
- Intoxicated beyond our alcohol policy
- Behaving inappropriately toward staff or other clients
- Using offensive, abusive, or harassing language
- Engaging in harassment, discrimination, or intimidation of any kind
Consequences of Inappropriate Behavior:
- Immediate termination of service without refund
- Removal from the premises
- Permanent ban from future services
- Legal action if necessary (police will be called for threatening behavior)
We are committed to maintaining a safe, respectful, and comfortable environment for all clients and staff.
7.3 Children and Minors
We welcome clients of all ages, including children 6 years and older for services.
- Children under 12 must be accompanied by an adult at all times
- Parents or guardians are responsible for supervising their children
- Children not receiving services must be supervised and cannot disrupt the salon environment or other clients' experiences
- We offer services tailored for younger clients with parental consent
7.4 Salon Environment
To maintain a pleasant experience for all clients, we ask that you:
- Silence or turn off mobile devices during services
- Keep phone conversations brief and quiet
- Respect other clients' relaxation and privacy
- Refrain from photography that includes other clients without their consent
- No outside food or beverages in service areas (complimentary beverages provided)
- No smoking or vaping inside the salon or within 25 feet of the entrance
8. INTELLECTUAL PROPERTY
8.1 Trademarks and Branding
"Earth Nail Spa" and all related logos, designs, taglines, and branding elements are the exclusive property of Earth Nail Spa. You may not use our trademarks, trade names, or branding without our prior written consent.
8.2 Photography and Content
Photographs, videos, and content created by Earth Nail Spa (including images of our services, salon, and clients with permission) are our property. You may not reproduce, distribute, or use these images for commercial purposes without our written permission.
Personal Use Exception: You may share photos of your own services on personal social media with appropriate credit to @earthnailspa.
9. PRIVACY AND DATA PROTECTION
Your personal information is collected, used, and protected in accordance with our Privacy Policy, available at earthnailspa.com or in-salon.

- We collect personal, health, payment, and appointment information
- We use Zenoti for booking, payment processing, and email marketing
- We use Google Analytics on our website for traffic analysis
- We do not sell your information to third parties

10. GIFT CERTIFICATES AND PROMOTIONS
10.1 Gift Certificates
Gift certificates purchased from Earth Nail Spa:
- Are non-refundable and non-exchangeable for cash
- Have no expiration date unless otherwise stated at time of purchase
- Are not replaceable if lost, stolen, or destroyed
- Cannot be combined with other promotional offers unless specifically stated
- Can be used toward services and retail products
- Remaining balances stay on the gift certificate for future use
10.2 Promotions and Discounts
- Promotional offers are subject to specific terms and conditions stated at time of offer
- Offers cannot be combined with other promotions unless explicitly stated
- We reserve the right to modify or terminate promotions at any time without notice
- Promotional pricing does not apply retroactively to previous purchases
- Promotional offers are valid only during the specified promotional period
- Membership pricing and benefits are not eligible for additional promotional discounts
11. FORCE MAJEURE
We shall not be liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to:
- Natural disasters (hurricanes, floods, earthquakes, severe weather)
- Power outages or utility failures
- Government orders, restrictions, or mandates
- Public health emergencies or pandemics
- Acts of terrorism or civil unrest
- Labor disputes or strikes
- Supplier or vendor failures
In such circumstances:
- We will make reasonable efforts to notify affected clients as soon as possible
- We will reschedule appointments without penalty or cancellation fees
- Membership billing may be paused during extended closures
- Refunds will be issued for prepaid services that cannot be fulfilled
12. DISPUTE RESOLUTION

12.4 Arbitration
If informal resolution fails, any disputes that cannot be resolved may be subject to binding arbitration in Dallas County, Texas, in accordance with the rules of the American Arbitration Association.

- Each party pays their own costs and fees
- The arbitrator's decision is final and binding
- You waive your right to participate in class action lawsuits
- Small claims court is exempt from mandatory arbitration
13. SEVERABILITY
If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.
14. ENTIRE AGREEMENT
These Terms and Conditions, together with our Privacy Policy, constitute the entire agreement between you and Earth Nail Spa regarding your use of our services and supersede any prior agreements, understandings, or representations, whether written or oral.
15. WAIVER
Our failure to enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of Earth Nail Spa.
No waiver of any breach of these Terms shall constitute a waiver of any subsequent breach.
